Guidelines regarding documents needed during the lockdown

The Government of India has advised all States and Union Territories to allow the transportation of goods both essential and non-essential during the ongoing coronavirus lockdown from March 25, 2020 to May 31, 2020. For more information click here:

To transport the goods, the operators should ensure the following documents are carried by truck owners/drivers:

Registration Certificate (RC) of Vehicle
National Permit 
5 Years Permit
Pollution Certificate
Insurance
Fitness Certificate
Driving License
Explosive License (Only for Oil & Gas Carriers)
E-WAY bill of Good
Invoice of goods
Goods Receipt (GR)

Note 1

E-WAY Bill of goods, Invoice of goods, GR (Goods Receipt) of goods should be available with the truck driver as without these documents, goods cannot be carried. The e-way bill is must and generated if the worth of goods transported is more than INR 50,000.

Note 2

Valid Truck driver’s license to be considered as a pass for intra and interstate movement of all trucks/goods/carrier vehicles (containing 2 drivers and 1 additional person).

It is advisable for the driver of an empty truck to carry the invoice, waybill of the delivery that he just made, or, of the pick up which he is about to make. For more information click here:

Extension of renewal dates for required/mandatory documents mentioned in Motor Vehicles(MV) Act 1988 and Motor Vehicles(MV) Rules 1989

  1. As per the notification from the Ministry of Road Transport and Highways, the validity of the above-mentioned documents, if expiring between 01st of February, 2020 to 30th of June, 2020, then such documents will be valid till the 31st of July, 2020. 
  2. So there is no need to renew these documents till the 31st of July, 2020. 
  3. In case any government official still stops your vehicle for the expiry of these documents then provide this information to the Government Official. Still, if the Official doesn’t agree then provide him the printed copy of the document. To download the document please click here:

Documents mentioned in Motor Vehicles Act 1988 and Motor vehicle Rules 1989 are:

  • Pollution Certificate
  • Permit Certificate( All Types)
  • Pollution Certificate
  • Fitness Certificate
  • Driving License

RC (Registration Certificate of Vehicle)

  • RC of vehicle is the document obtained upon registration of vehicle in local Transport Office as per Motor Vehicles Act 1988. 
  • As per notification from Ministry of Road Transport and Highways, the validity of RC if expiring between 01st of February, 2020 to 30th of June, 2020  then it will be valid till 31st of July, 2020.

Permit (All Types: National Permit, 5 Year Permit etc)

  • Different Permits for vehicles are required depending upon the area of Operation of vehicle (Local, State, National etc.) and time period of Operation of the Vehicle. 
  • Permit documents obtained upon registration of vehicle in local Transport Office as per Motor Vehicles Act 1988. 
  • As per notification from Ministry of Road Transport and Highways, if Permit of your vehicle  will be expiring between 01st of February, 2020 to 30th of June, 2020  then Permit of your vehicle will be valid till 31st of July, 2020.

Relief in Motor Insurance

  • Extension of Third Party Motor Insurance

If your current compulsory third-party Motor insurance policy is expiring between March 25, 2020, and April 14, 2020, and you are not able to renew your policy because of country-wide lockdown then you can renew such motor insurance policy by April 21, 2020.   • Update in Third Party Motor Insurance – Effective from 16-Apr-2020

The government has extended the deadline to renew insurance policies which are due for renewal during the period on and from the 25th March 2020 up to the 3rd May 2020 till 15th May 2020.  For more information click here: https://pib.gov.in/PressReleasePage.aspx?PRID=1614916

  • Claim
  1. The normal response time for policyholder complaint redressal is 15 days.
  2. An additional 21 days is allowed for all complaints which are received on or after 15th March and up to 30th April 2020. 
  3. Claims arising on account of COVID -19 will be processed immediately.
  • No Hike in Premium Rates
  1. Another important point to be noted is that IRDAI will not increase the premium rates of third party motor insurance for all vehicle categories for the Financial Year 2020-21.  
  2. While every year, IRDAI revised new rates on April 1st to the tune of 10-40 percent, this year i.e 1st April 2020 onwards all insurers shall continue to charge the same rates that are currently being charged for Motor Third Party Liability Insurance Cover.

Fitness Certificate

  • Fitness Certificate is needed to ascertain whether a required vehicle is suitable to carry the goods as per Motor Vehicles Act 1988 local Transport Office.
  • As per notification from Ministry of Road Transport and Highways, if Fitness Certificate of your vehicle  will be expiring between 01st of February, 2020 to 30th of June, 2020  then Fitness Certificate of your vehicle will be valid till 31st of July, 2020.

Driving License

  • Driving License of vehicle driving is required as per Motor Vehicles Act 1988 through local Transport Office. 
  • As per notification from Ministry of Road Transport and Highways, if your Driving License(DL) will be expiring between 01st of February, 2020 to 30th of June, 2020 then your DL will be valid till 31st of July, 2020.

Explosive Certification

  • PESO (Petroleum and Safety Organisation) has provided relief to all those operators who are involved in transportation of explosives.
  • All the licences having validity till 31st of March 2020 shall be deemed to have validity extended till 30th September 2020 under the Explosive Rules 2008.

E-Way Bill

  • The Government of India has provided relief to transporters in E-Way bill.

 If an e-way bill has been generated and its period of validity expires during the period 20th March 2020 to the 15th day of April 2020; the validity period of such an e-way bill shall be deemed to have been extended till the 31st of May, 2020. For more information click here:
